Overview

Jim has a more than twenty year track record of successfully representing businesses and financial institutions in domestic and international litigation and arbitration matters.  His extensive experience includes guiding clients in contract, fraud, RICO, regulatory, employment, commercial real estate, professional liability, appellate, intellectual property, trade secret, insurance, and reinsurance matters.  Regarded by clients as a skillful writer and oral advocate, Jim takes pride in working with clients to efficiently obtain results.

Experience

Adept at banking litigation, Jim successfully represented a foreign bank in a RICO and fraud mass action that opposing counsel described as the largest internet fraud case in history. After years of litigation, and after obtaining victories dismissing most plaintiffs on motions to dismiss or for summary judgment, the remaining plaintiffs abandoned their suit.

Jim also won an arbitration award for a client bank in a matter involving interpretation of various real estate contracts relating to the sale by the bank of a large property.

Experienced in insurance related matters, Jim successfully represented a European insurer in one of the largest property insurance trials in history - the trial arising out of the destruction of the World Trade Center. He served as second chair during a 10-week federal court trial that resulted in a verdict in favor of his client.

Jim also successfully represented a Mexican reinsurer in a federal court appeal concerning reinsurance coverage.  The Second Circuit ruled his client was not required to reimburse declaratory judgment expenses under 26 facultative certificates.

Jim obtained summary judgment awards for his gaming enterprise client in a large tort and contract litigation involving the enterprise and its owners.

Jim has navigated clients through significant professional liability actions, successfully resolving these disputes for his clients through settlement.  This includes representing a liquidating trust in a malpractice suit against an international law firm concerning securities advice and representing a client in a malpractice suit against a large law firm concerning a security agreement.

Jim provides advice to a highly regulated client on a broad range of regulatory issues, and won a significant administrative appeal before a regulatory commission.

Jim obtained dismissal of a lawsuit on behalf of a large investment firm in a tort and contract action.
